Terms & conditions

These General Conditions govern the vehicle rental service contract that binds You to Nomádico Pxm. By signing the rental agreement during the reservation procedure, You accept the terms. We therefore recommend that you read them carefully.

Definitions

“Renter” means the Renter and the driver(s) mentioned on the rental contract;

“Nomádico” designates the company “Nomadico Pxm”, whose company name appears on the rental contract;

“Vehicle” means the rented vehicle;

“Contract” means the rental contract concluded between Nomádico and the Renter, subject to these general rental conditions;

“Damage” means any damage to the Vehicle including damage to the vehicle’s equipment (example: power station, roof tent, etc.)

“Claim” means any event that occurs and causes one or more damages, which may be compensated by the insurer.

Rental conditions

The name of the Renter indicated on the rental contract is that of the main driver, who must be present when signing the said contract and to whom the costs related to the rental will be invoiced. It is possible to add additional drivers who will be mentioned in the rental contract, without any other fee. Only the drivers mentioned in the rental agreement are authorized to drive the Vehicle.

The Renter as well as the authorized drivers mentioned in the rental contract are required to present a valid identity card or passport and a valid driving license. The Renter and the authorized drivers are liable to Nomádico for the full execution of these rental conditions. As soon as the Vehicle is handed over, the Renter becomes totally responsible for it. Nomádico reserves the right to terminate the rental immediately and automatically without justification or compensation in the event of violation by the Renter of one of the essential obligations of the rental contract, in particular the conditions of use of the Vehicle, the payment and return conditions.

The rental contract & agreement are personal and non-transferable. It is concluded for a fixed period mentioned in the agreement.

Use of the Vehicle

The Renter undertakes:

• to allow the Vehicle to be driven only by the drivers mentioned in the rental contract;
• to use and maintain the Vehicle reasonably, under normal conditions of use;
• to travel only on roads suitable for car traffic;
• not to travel outside the authorized territory comprising the entire Republic of Mexico;
• to use the rented Vehicle in accordance with the provisions of the Highway Code and more generally in accordance with the legal and regulatory provisions;
• not to use the Vehicle under the influence of an alcoholic state or under the influence of drugs or any other substance affecting consciousness or the ability to react;
• to comply with the destination of the Vehicle (private vehicle) and in particular not to sublet the Vehicle, transport passengers for a fee, nor in a number greater than that of the seats in the vehicle, not to participate in competitions, rallies or car races;
• not to use it for illicit, immoral or unforeseen purposes by the manufacturer;
• not to hitch other vehicles, trailers or any other object to it and not to make any modifications to it;
• to lock the Vehicle when parked;

The vehicle must be returned clean, in its original condition. Otherwise, Nomádico reserves the right to charge for special cleaning upon return of the vehicle.

Vehicle condition

By signing the contract & agreement, the Renter accepts the Vehicle in the state in which it is and undertakes to return it in the same state. A descriptive statement of the Vehicle is attached to the contract. It signals any damage apparent to the Vehicle, the number of kilometers traveled by the Vehicle and the level of fuel.

The Renter undertakes to check that the condition of the Vehicle corresponds to the description and to write a contradictory report if necessary before leaving. Failing this, the rented Vehicle will be considered as conforming to the description. Nomádico will not be able to take any account of complaints concerning visible damage which will not have been reported on the description.

Nomádico provides the Renter with a Vehicle filled with a certain amount of fuel. The Renter has to give back the Vehicle with the same amount of fuel. Failing this, the missing fuel will be invoiced to the Renter on his return.

Maintenance

Routine maintenance of the vehicle is the responsibility of the Renter. Thus, depending on the number of kilometers traveled during the rental, the Renter will have to carry out the usual checks (engine oil level, tire pressure, etc.). The Renter must always remain vigilant to the signals emitted by the warning lights, and take the associated measures such as a possible emergency stop.

Breakdowns, accidents & thefts

In the event of a breakdown of the Vehicle or an accident requiring immediate or urgent repairs, the Renter must contact Nomádico Pxm before carrying out any repairs (including if it concerns tires).

In the event of a breakdown or damage suffered by the Vehicle, even when they do not require immediate repair, the Renter must inform Nomádico Pxm within 12 hours of becoming aware of it.

The submission of a completed statement, signed by a federal police officer who came to record the accident as well as the identified third party, whether the Renter is responsible or not is mandatory. Failing this, it is impossible to submit a report within this period, the insurance and assistance guarantees referred to herein are inapplicable and the Renter will be liable for all damages incurred by him. In particular those suffered by the Vehicle within the limit of their market value and the costs related to its immobilization.

In any case, in the event of damage caused to the Vehicle, the Renter will be liable for file processing costs and immobilization costs calculated according to the category of the Vehicle, refundable in the event that his responsibility is not engaged.

In the event of a breakdown not attributable to the Renter, Nomádico undertakes to cover all the costs of breakdown assistance and repair of the Vehicle, as well as to reimburse the Renter the full amount relating to the unused rental days.

In the event of theft of the Vehicle, the Renter must, within 12 (twelve) hours from the time he becomes aware of it, make a declaration of theft to the competent authorities and submit to Nomádico the report of the filing of the complaint, the papers and keys to the vehicle.

In the event of the theft of the keys and/or papers of the Vehicle, the Renter must ensure that it is reported to the competent authorities so that this appears in the complaint filed.

In the absence of compliance with these provisions, the Renter will be liable for all damages attributable, in particular those suffered by the vehicle within the limit of its market value and costs related to its immobilization.

Insurance

Basic coverage
Nomádico Pxm proposes to the Renter a basic coverage policy. Below what is included:

• civil liability for damages to third parties,
• occupant medical expenses,
• legal expenses,
• insurance road assistance,
• unlimited mileage,
• free additional drivers,
• GPS tracker.

However, the Renter will be responsible for paying the full amount of money in case of total or partial theft of the vehicle. Also for all damages caused to the rented vehicle, as well as to the various equipment included in the vehicle rental.

Comfort coverage
Nomádico Pxm proposes to the Renter a comfort coverage policy. The Renter can add this option while making the booking. Below what is included:

• damage waiver with a 10% deductible,
• theft protection with a 20% deductible,
• civil liability for damages to third parties,
• occupant medical expenses,
• legal expenses,
• insurance road assistance,
• unlimited mileage,
• free additional drivers,
• flat tires,
• broken windows,
• GPS tracker with panic button.

Damages to roof tents and other camper equipment are not covered by the Insurance. No guarantee is offered in this respect. Consequently, the Renter will be liable for all damages that are attributable, in particular those suffered by the equipment within the limit of the product’s invoice.

Forfeiture of warranty

Drivers not named in the rental contract, and for whom the Renter remains responsible, will not be able to claim the benefit of the damage or theft of the Vehicle and assistance guarantees.

In general, failure to comply with the conditions of rental, use and return of the Vehicle mentioned in the general rental conditions will result in the forfeiture of the contractual guarantees taken out. The Renter will then be responsible for the entire loss under the conditions of the common law of liability.

Reservation and payment

By accepting these terms & conditions, the Renter agrees to pay Nomádico Pxm by the various means of payment offered on the site when booking, or by other means following an exchange with Nomádico Pxm.

To validate the reservation, the Renter must have paid the amount of the reservation (including extras). The deposit will be paid during the check-in of the Vehicle.

At the time of booking, on the website www.nomadico-pxm.com, the Renter must pay 100% of the total price corresponding to the rental services. The total invoicing price includes the amount of the rental (VAT included) for: the category of Vehicle, the dates, the optional services payable online (special equipment, insurance, delivery, etc.) as well as the elements included in the price at the time of booking, at the rates indicated by Nomádico Pxm. Any other equipment and optional service to which the Renter wishes to subscribe after the reservation will be paid directly to Nomádico Pxm, when taking possession of the Vehicle.

The Renter also authorizes Nomádico Pxm to debit the deposit, in the event of additional costs at the end of the rental, in the event of missing fuel, damages or any other event according to the rates stipulated in the rental contract. The number of kilometers traveled during the term of the rental contract is that indicated by the meter of the Vehicle. In the event of violation of the Highway Code, Nomádico Pxm also reserves the right to charge administration fees.

In the event of non-payment, the Renter expressly accepts the forfeiture of the term for invoices not due and the termination of the contract as of right, as well as the immediate return of the Vehicle.

Modification of the reservation

The Renter may cancel or modify the type of Vehicle, and/or the dates of his reservation, subject to availability and the limitations set out below, by contacting Nomádico Pxm beforehand. Changes to the reservation are subject to the following restrictions:

For any modification, if the price of the modified rental is higher than the initial total amount to be paid, the difference will be invoiced and must be paid before the date of taking possession of the Vehicle. If the price of the modified reservation is lower than the initial total amount, the Renter will not be reimbursed for the difference.

In the event of cancellation of a reservation made with the refundable option, the Renter is fully reimbursed (except the refundable option already paid), if the cancellation request to Nomádico Pxm is made at least 24 hours before the start of rental. If the Renter does not take possession of his vehicle within 24 hours of the date and time of reservation mentioned in his reservation, this will be worth cancellation on his part.

The “Refundable option” ensures that the Renter can cancel his reservation free of charge up to 24 hours before the start of his rental, upon simple written request.

Unavailability of the Vehicle

In the event that Nomádico Pxm finds itself unable to rent the Vehicle to the Renter on the scheduled rental date, Nomádico Pxm undertakes to fully reimburse the sums received by the Renter.

Deposit

The deposit is a security payment made by the Renter to cover any potential damages or charges incurred during the rental period. It is refunded when the vehicle is returned undamaged.
The deposit amount is displayed during the booking process together with the insurance coverages.

The deposit is always refunded after check-out by bank transfer. It may take up to 3 days to be displayed on your bank account.

In case of any damages (visible or noticeable), the deposit will be kept during the procedure with other parties (such as the insurance company, the mechanics, etc.). The customer will be held informed during the process, and the amount of money for the reparations will be subtracted from the deposit.

Extension of rental

The Renter must request from Nomádico, at least 48 (forty eight) hours in advance, the extension of the rental by accompanying it with the necessary provision.

Nomádico reserves the right to refuse the extension, without compensation for the Renter, with the obligation for the Renter to return the Vehicle on the scheduled date.

Service fee

These fees enable Nomádico Pxm to keep the business running efficiently, as well as the related expenses (maintaining vehicles in good condition, cleaning of the vehicles, costs of our business facilities – office and vehicle workshop)
Nomádico Pxm charges a one-time service fee of 250$ MX.

Electronic equipment & tool y safety box

Nomádico offers free loans of electronic equipment for a variety of uses. Items available include:

• charger adapter 12V USB / USB-C
• audio cable AUX
• charging cable (compatible with old and new generation iPhone and Android devices)
• audio/phone adapter (iPhone old and new generation, Android compatible)

Nomádico provides a safety box containing essential tools for various uses.

Terms of use
The condition of the equipment will be checked at check-in and on return at check-out.
In the event of damage or loss preventing further use, Nomádico reserves the right to invoice the equipment at the purchase price from the brand’s official supplier.

Return of the Vehicle

The rental ends with the return of the Vehicle, its keys, any original papers, and accessories rented to Nomádico Pxm, at the return time stipulated in the rental contract. Only this step allows you to end the rental contract.

In the event of the return of the Vehicle outside the times defined in the rental contract, and without written exchanges with Nomádico Pxm, Nomádico Pxm reserves the right to charge restitution costs.

The Renter must return the Vehicle in a “normal and daily” state of interior cleanliness. Exterior cleaning and interior finishing are then provided by Nomádico Pxm. In the event that an extraordinary and abusive state of dirtiness is observed, Nomádico reserves the right to charge additional restitution costs.

Regardless of the options taken out, this must be taken into account:

• no food must remain in the cupboards or the cooler of the Vehicle;
• the cooler must be clean;
• the dishes must be clean;

Otherwise, Nomádico Pxm reserves the right to charge restitution costs.

Fines

The Renter is responsible for any offenses committed during the rental period. The contact details of the Renter may be communicated to the competent authorities. In the event of intervention by Nomádico, particularly in the processing of fines, tickets or reports, the Renter will be liable for file processing costs. The Renter expressly authorizes Nomádico to use his means of payment, in particular bank card, to be paid the corresponding sum.

Personal data

Nomádico, in its capacity as data controller, undertakes to comply with its obligations in terms of the protection of personal data.

The Renter is informed that Nomádico holds a personal data file collected when signing the rental contract.

They are subject to processing allowing Nomádico to manage the rental and related operations, in particular billing, and to send the Renter, if necessary, commercial information.

Nomádico undertakes to protect the personal data of users against any loss, destruction, alteration, access or unauthorized disclosure.
